You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Gift Cards

These conditions apply to the usage of the Facethetics Gift Card (gift card), issued by Facethetics (Facethetics).

Purchasing or using a Facethetics gift card signifies that you accept these conditions. Facethetics may, in its complete discretion, refuse to sell gifts cards to any person at any time for any reason.

If you let another person use your gift card, you must tell them that they will be bound by these conditions. The law of Queensland applies to this agreement. By entering into this agreement you unconditionally submit to the jurisdiction of the courts of Queensland.

The gift card may be used to purchase goods or services at any Facethetics. Gift cards cannot be redeemed for cash, returned for a refund, have their balances consolidated to a new gift card, or be replaced after expiry and are not legal tender, account cards, credit or debit cards or securities.

Anyone holding the gift card can use its value to make purchases so your gift card should be kept secure. If your gift card is lost or stolen, immediately report this to the Facethetics from which it was purchased. We may be able to stop gift card value being used, but take no responsibility and are not liable for any loss suffered by you as a result of a lost or stolen gift card.

We may replace a faulty, lost or stolen gift card in our absolute discretion. Any replacement gift card will have the same unused value (at the time of replacement) and expiry date. Gift cards will be void if they are defaced, mutilated, altered or tampered with in any way. We may subject gift cards to verification and security checks in our absolute discretion.

We may cancel any gift card, or the gift card scheme, for any reason at any time without notice. If so, we may either provide a refund or a replacement gift card of equivalent value unless we reasonably suspect fraud in relation to a gift card.

The gift card remains the property of Facethetics. The gift card will expired one year from the date of issue.

Gifts cards are valid for one year from the Date of Issue. After the gift card has expired, it is no longer valid. All transactions will be declined. The unused value will not be refunded and will become the property of Facethetics. The gift card is not valid for cosmetic injections.

An anti-wrinkle club membership in no way guarantees that you will be eligible to receive an anti-wrinkle treatment.

At every single scheduled gift card appointment every client will be examined, assessed and consulted by our Registered Nurse, irrespective of if I gift card has been purchased or prior appointments.

You are considered unsuitable for any cosmetic injectable treatment irrespective of purchasing a gift card until an obligation free consultation has been performed at your appointment, prior to any and every treatment, by our Registered Nurse, and you have been deemed suitable for the treatment requested, and a prescription for your treatment issued by our Prescriber. All gift cards issued are considered to be invalid before you have been deemed suitable and warrated for the treatment requested, and a prescription for your treatment issued by our Prescriber.

Facethetics reserves the right to refuse any treatment if, after the obligation free consultation at every scheduled appointment, it is deemed unsuitable, unnecessary, or unwarranted by our Registered Nurse or Prescriber.

Facethetics will at all times, and immediately, refund all subscription, gift card or other fees already charged to the client if the client is deemed unsuitable for the treatment, or it is deemed by our Registered Nurse or Prescriber to be unnecessary or unwarranted. You agree to these terms by purchasing pre-paid Anti-Wrinkle Club treatments.

Cosmetic Injections

Cosmetic injection clients must be deemed medically fit and suitable for treatment, following a consultation with one of our injectors. Facethetics reserves the right to refuse treatment if the location provided for treatment is deemed by our Cosmetic Injector to be not suitable, sanitary, or does not have handwashing facilities. Facethetics reserves the right to refuse treatment at any time, if the client is deemed unsuitable for treatment, or the treatment is deemed unnecessary, or unwarranted by our Registered Nurse or Prescriber.

At every single scheduled treatment appointment every client will be examined, assessed and consulted by our Registered Nurse, irrespective of pre-payment or prior appointments.

Our Cosmetic Injector may ask for photo identification that the client is over 18 years of age and reserves the right to refuse treatment if this is not provided. No-one under the age of 18 will be administered any cosmetic injectable treatments. If the client is pregnant or breastfeeding they may be refused treatment at the discretion of our Cosmetic Injector and Prescribing Doctor. Only the 30-minute consultations are complimentary, a consultation longer than 30 minutes will attract a fee of $230.00, in accordance with the cosmetic injections pricing schedule, at our discretion. Price per area is defined a sufficient product to achieve the medically appropriate result. For legal reasons, the product names cannot be used in advertising. Please contact one of our injectors at our clinics for details. Products purchased in a package can only be used for one appointment. Packages cannot be split over appointments.

Before and After Photos

Facethetics would like to gather resources such as photographic images, written testimonials, video and or audio from you for the purpose of creating educational and promotional material. These images and resources will contain information about your medical diagnosis and treatment, as such; it would be regarded as sensitive data, which by law requires your explicit consent to allow us to process it. If chosen to participate you will be required to sign a legal consent form by which you will confirm that the person named in the release notice has agreed to the publication of the resources by Facethetics both now and in the future. Through the signed consent, Facethetics will be granted the right to use the resources on such materials, as it deems appropriate. This includes and is not limited to websites, the Internet, newsletters, publications, radio, television and newspapers etc. In doing so Facethetics may crop and/or collage any of the resources.

By signing the consent form, or agreeing to these terms and conditions, you release and forever discharge Facethetics, its agents, officers and employees, from any and all claims and demands arising out of or in connection with the use of the photographic images, written testimonials, video and or audio, including but not limited to, any and all claims for invasion of privacy, defamation, or financial compensation and you waive all moral rights that you may have in the photographic images, written testimonials, video and or audio.

Cancellations and Refunds

Facethetics have a ‘no refund’ policy on purchases if you simply change your mind, except if you are deemed unsuitable for a treatment by our Registered Nurse, or it is deemed unnecessary, unneeded or unwarranted.

Treatments/services are not transferable to other individuals or clinics except if you are deemed unsuitable for a treatment by our Registered Nurse, or it is deemed unnecessary, unneeded or unwarranted.

We require at least 24 hours’ notice to be given for any appointment cancellation via phone call or txt only.

If you cancel within 24 hours of your appointment or do not attend a booked appointment, we reserve the right to charge a cancellation fee of 50% of the treatment cost, or $100.00, whichever is greater.

In the case of prepaid treatments, the treatment will be forfeited.

Deposits paid for cosmetic injectable treatments are non-refundable except if you are deemed unsuitable for a treatment by our Registered Nurse, or it is deemed unnecessary, unneeded or unwarranted.

In the event you are unsatisfied with a treatment outcome Facethetics reserves the right not to refund or remedy without a follow up appointment being attended with the patient present.

Due to the nature of cosmetic injectables, Facethetics reserves the right to refuse a remedy or refund if you do not notify us of an adverse reaction or unsatisfactory result within four weeks of your treatment.

Facethetics reserves the right to provide a remedy in the form of; massage of dermal filler to dissipate lumps or unevenness; top-up injections of anti-wrinkle treatments; and/or further follow up consultations, in lieu of dissolving and re-treating dermal filler areas, or a full or partial refund.

Refunds will be provided where required under the Australian Consumer Law and our policy does not impact your statutory consumer rights to a remedy or refund.

Anti-Wrinkle Club Subscriptions

If you pre-pay for treatments with the Ant-Wrinkle Club you will pay an amount according to the pre-payment schedule. There is no refund on pre-pays and they are not transferable to other individuals, treatment areas or clinics, except if you are deemed unsuitable or unwarranted for a treatment by our Registered Nurse as per pre-treatment consultation guidelines. Pre-pay Anti-Wrinkle Club vouchers have a 12 months expiry date. 24 hours’ notice is required for any pre-paid appointment cancellations. If you cancel a pre-paid appointment within 24 hours or do not attend the appointment, the treatment will be forfeited. Anti-Wrinkle Club subscriptions cannot be cancelled before the minimum 16 week payments have been made, if a voucher has be redeemed in this time. If a subscription is cancelled, a gift voucher will be issued within 24 hours of the equivalent value of any unredeemed payments.

At every single scheduled anti-wrinkle club appointment every client will be examined, assessed and consulted by our Registered Nurse, irrespective of subscription to the Anti-Wrinkle Club or prior appointments.

You are considered unsuitable for any cosmetic injectable treatment irrespective of prior appointments or subscription to the Anti-Wrinkle Club until an obligation free consultation has been performed at your appointment, prior to any and every treatment, by our Registered Nurse, and you have been deemed suitable for the treatment requested, and a prescription for your treatment issued by our Prescriber.

Facethetics will at all times, and immediately, refund all subscription or other fees already charged to the client if the client is deemed unsuitable for the treatment, or it is deemed by our Registered Nurse or Prescriber to be unnecessary or unwarranted. You agree to these terms by purchasing pre-paid Anti-Wrinkle Club treatments.

Pout+Platter Party

Facethetics reserves the right to refuse treatment to any person at any time deemed under the influence of alcohol or drugs without hesitation. Every person receiving treatment must undergo a complimentary consultation. Our hostess reserves the right to refuse service of an alcoholic beverage at any time. Facethetics may provide gifted complimentary Prosecco or equivalent sparkling wine – or alternatively a platter, ice, and strawberries but does not take responsibility for any service of alcohol. Five guests must purchase treatments upfront at the event or pre-purchase their treatment for one guest to receive one complimentary treatment to the value of $250 or the equivalent value off the price of another treatment. Facethetics reserves the right to provide an equivalent sparkling alcoholic beverage in replacement of Prosecco without notice. Facethetics Alcohol Provision Policy Facethetics reserves the right to refuse service of any gifted alcoholic beverage prior to treatment. No gifted alcohol will be served to a person prior to treatment. Alcohol will only be served to any person undergoing a treatment until 30 minutes post treatment entirely at Facethetics discretion. Alcohol provided will be no more than 5% alcohol volume and only one single glass containing less than one standard drink will be served to each person. Alcohol Consumption Liability Waiver The client (you) acknowledges that the serving of alcohol at your event carries potential risks and dangers beyond the control of Facethetics. The client (you) also acknowledges that Queensland has responsible service of alcohol laws in place. The client (you), as the responsible party, assumes all liability for yourself and all event participants, invitees and other guests for any form of negligence that may arise from the consumption of alcohol by the event participants, invitees and other guests. The client (you) hereby agrees to indemnify, defend, release, and hold harmless Facethetics, including the owner, members, agents and employees (collectively “Releasees”) from all liability to you, your invitees/guests, your next of kin, your conservators, assigns, heirs, guardians or other legal representatives for any and all liability, claims, demands, actions, and causes of actions whatsoever, arising out of or related to, any loss, damage, medical side effects, injury, illness, wilful or neglectful acts or misadventure arisen or sustained from the consumption of any complimentary alcohol gifted by Facethetics. The client (you) agrees that any consumption of alcohol gifted by Facethetics by you or your invitees/guests is of your/their express individual consent and entirely at your/their personal discretion. The client (you) hereby waives all legal rights to pursue any form of legal action against Facethetics and the Releasees. THE CLIENT (YOU) HAS READ THIS AGREEMENT AND HAS SIGNED IT FREELY. THE CLIENT (YOU) FULLY UNDERSTANDS IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE GREATEST EXTENT OF THE LAW.

A Pout+Platter party booking of 5 persons or more in no way guarantees that the host will be eligible to receive a complimentary treatment.

Every client receiving a treatment will be examined, assessed and consulted prior to being deemed eligible for any treatment, by our Registered Nurse, irrespective of hosting an event or prior appointments.

Every client is considered unsuitable for any cosmetic injectable treatment irrespective of prior appointments or Pout+Platter Party booking until an obligation free consultation has been performed at the appointment or event, prior to any and every treatment, by our Registered Nurse, and the client has been deemed suitable for the treatment requested, and a prescription for their treatment issued by our Prescriber.

If the event host is deemed unsuitable for, or a complimentary treatment is deemed unwarranted or unnecessary, a gift voucher to the value of (1)Hydrating Lip Filler Treatment, or (1)Area Anti-Wrinkle will be issued to the eligible event host to gift or redeem (after an obligation free consultation deeming them suitable for the treatment).

Buy Now, Pay Later

Any payment plan agreement in no way guarantees that you will be eligible to receive any cosmetic injectables treatment.

At every single scheduled appointment every client will be examined, assessed and consulted by our Registered Nurse, irrespective of agreement to a payment plan, a pre-payment or deposi,t or prior appointments.

You are considered unsuitable for any cosmetic injectable treatment irrespective of prior appointments or payment plan agreement until an obligation free consultation has been performed at your appointment, prior to any and every treatment, by our Registered Nurse, and you have been deemed suitable for the treatment requested, and a prescription for your treatment issued by our Prescriber.

I acknowledge that the credit card(s) or payment method(s) I am using to make this purchase will be active, valid and have sufficient funds available during the entire term of the payback period. If for any reason my payment is declined, I will provide an alternative, valid payment method.

I understand that I may be assessed a late fee(s) if a payment is missed on any of the agreed-upon payment dates for any reason whatsoever.

I agree that should my payment plan fall into default, I sign all allowance and representation over to Facethetics to re-open my plan on my behalf without notice, and agree to allow Facethetics as my authorized representative under my given name to re-open my plan on my behalf at any time.

I agree that should my payment plan default, I will allow Facethetics and Facethetics Agents without notice and delay to use my nominated payment method to debit an amount of their choosing up to the total outstanding balance of my payment plan, at intervals of their choosing, including daily, weekly, or monthly, until my debt is fully paid.

I agree that any fees, payments or expenses incurred by Facethetics in the process of recovering unpaid outstanding and defaulted amounts due may be added to my total debt and recoverred by Facethetics.

I understand that I am legally bound to these terms and required by law to make all payments on the agreed-upon payment dates.

Limit of one discount per customer applies. If a customer is receiving multiple treatments, discount applies to overall total cost only. Discounts cannot be combined or transferred. No discount applies when paying via payment plan or via Zippay or Zipmoney. Treatments must be completed in the same day except by prior approval. Discount time frames are stated on social media posts and are for a limited time only. Further discounts (eg flash sale/party discount) apply to FULL PRICED ITEMS ONLY not flash sales or monthly specials. Customer must mention the applicable discount or sale at the time of booking or at the appointment before making payment to receive it. If discount is not mentioned at or before booking or payment then this discount is forfeited by the customer.

PACKAGE PRICING/CUSTOM PACKAGES

Custom package pricing may vary and is applicable to one appointment only and one individual customer. Custom package pricing is not transferable or applicable between similar appointments or different customers.

TRANSFER OF OR HOLDS ON TREATMENTS

Treatment pricing is for full use of all treatment elements in a single appointment for a single client. If a client wishes to 'hold' part of a treatment element this must be communicated to and agreed to by the treating practitioner prior to the commencement of appointment. The storage or any part of a treatment for later use by a client is at the discretion of the treating practitioner; and if agreed to: must be within 6 weeks of initial treatment, and; incurs a minimum of $50.00 fee for the additional costs incurred by the practitioner. Treatments held are not transferable between patients. Any transfer of treatment 'credit' is at the discretion of Facethetics.

TRAINING MODEL APPOINTMENTS

Limit of one appointment per customer applies. If a customer is receiving multiple treatments, a limit of 2ml of filler maximum per customer applies. Full prices are charged for treatments paid for via payment plan or Zippay. The customer acknowledges that this is a training day and their results or appointment may not be as satisfactory as standard Facethetics expectations.

MY FACETHETICS/MY HEALTH/PAYRIGHT PAYMENT PLANS

To be eligible for a payment plan you must be: employed; an Australian Citizen; have a valid Australian drivers licence, medicare card or Australian Passport; be over 18 years of age; not be declared bankrupt or in a debt agreement; and agree to all terms and conditions on the My Facethetics Payment Plan direct debit agreement, viewable at: https://intakeq.com/new/glMBix
All payment plans have a $360 minimum spend and $6000 maximum spend. 3.9% administration fee applies to all total payment plan amounts. All payment plans must include a 20% of total deposit, payable on the day of appointment. Payment plans are six weeks in length with equal weekly repayments of total treatment amount minus 20% deposit paid on day of appointment, with repayments beginning 1 week from date of treatment.
